General Terms and Conditions of Sale

I. TEACHING AND SUPERVISION SERVICE

Registration for supervised services from Cors'Aventure implies unconditional acceptance of these general conditions by the subscriber, who undertakes to inform each participant of all the terms.

ART. 1 – PARTIES INVOLVED

Cors'Aventure offers supervision and teaching of outdoor sports disciplines: canyoning, sea kayaking, sailing, paddleboarding, rafting, white water kayaking, mountain biking, hiking. All activities offered are supervised and led by state-certified guides (B.E.E.S / D.E.J.E.P.S) in their respective disciplines and meeting their legislative obligations (U.R.S.S.A.F, R.C.P, D.D.C.S.P.P declaration, professional cards).

ART. 2 – REGISTRATION AND BOOKING

All our activities are by reservation. For this, you have several options: by filling in the online booking form (www.corse-aventure.com) or by contacting Cors'Aventure directly by email (info@corse-aventure.com), by telephone (04-95-25-91-19 / 06-72-03-49-22) or at the reception of our base in Eccica-Suarella.

GROUP OUTINGS: Registration is effective from the moment the subscriber receives a confirmation email for the chosen outing.

PRIVATE OUTINGS (institutions, companies, associations): Registration is effective upon receipt of the deposit corresponding to 30% of the total amount of the service and a booking confirmation email for the chosen outing.

In both cases, the balance will be paid directly to the professional in their own name, at the start of the activity.

ART. 3 – PRICING

Cors'Aventure's rates are presented on the website and on the brochure available free of charge at hotels, campsites, tourist offices etc.

Prices include: the organisation, the supervision service provided by a state-certified guide and the loan of technical and safety equipment necessary for the practice of the chosen activity (full 5mm neoprene wetsuit, neoprene socks, helmet, harness, paddle, life jackets, etc.).

Some products include the possibility of equipment loan, on simple request (e.g.: canyon shoes, etc.)

In all cases, we invite you to refer to the product data sheet, available on our website or on simple request.

Prices do not include: possible equipment rental (e.g.: GoPro, portable), transport to the activity location (meeting point and practice site) and personal expenses.

For full-day outings, meals (packed lunch, water, snacks) are at the client's expense, unless otherwise stated.

ART. 4 – PAYMENT METHOD

For supervision services, payment must be addressed (labelled), directly to Cors'Aventure. This mention will be stipulated at the time of booking.

Accepted payment methods: cheque, holiday vouchers, bank transfer, bank card (secure online payment) or cash.

ART. 5 – CONDITIONS OF PARTICIPATION

Our activities are open to all; however, depending on the activities and routes, certain conditions must be taken into account (age limit, ability to swim, technical level, physical condition, etc.).

Cors'Aventure has no means of verifying the level of sporting practice of its clients.

It is therefore up to each participant to have assessed their physical fitness in accordance with the route choices they wish to make. To find out these conditions, please refer to the route data sheets (available on our website www.corse-aventure.com).

For canyon and white water activities, it is essential to be able to swim and submerge.

You must not have any medical contraindication to the practice of the chosen activity.

IMPORTANT: You do not have a medical contraindication but you are dependent on special care or medical treatments (asthma, diabetes, etc.) or your state of health requires particular attention (fragile joints, back problems, compulsory wearing of glasses, etc.), you must imperatively inform the instructor before the start of the activity and bring the appropriate emergency medication, as recommended medically.

ART. 6 – INSURANCE AND LIABILITY

Cors'aventure is insured in Professional Civil Liability for its own activities and for costs occasioned by a possible rescue operation.

We strongly advise each participant to be covered by civil liability insurance and/or personal accident insurance with the insurer of their choice for the practice of white water and/or mountain sports. Indeed we cannot substitute ourselves for the individual civil liability of each participant.

SARL Cors'aventure is insured in civil liability for all the activities it offers and its liability cannot be engaged for activities booked with other service providers.

In the event of a bodily injury accident, the liability of SARL Cors'aventure and the supervising instructor is released as soon as the victim is taken care of by the competent emergency services, and any subsequent hospitalisation will be the responsibility of the injured party's personal insurance.

The practice of outdoor activities takes place in a specific environment known as a «risk» environment.

Each participant is aware, given the specific nature of the activities offered, that they may run certain risks due in particular to remoteness, isolation and the specific nature of the environment (river, cave, cliff, etc.). They accept these knowingly and must comply with the rules of caution and follow the advice given by the professionals.

The participant/client is responsible for the equipment that has been loaned to them for the activity. The professional cannot be held responsible for any harm that may be caused by the equipment made available.

In the event of theft or damage to loaned equipment, the participant/client may be asked for compensation related to wear or full reimbursement of the equipment.

The professionals (instructors) and SARL Cors'Aventure cannot be held responsible for the loss, theft (including from vehicles) or breakage of objects (e.g.: glasses, cameras…) that participants might take with them during the activity and that could occur during the activity.

ART. 7 – CANCELLATION / INTERRUPTION BY THE CLIENT FOR DAY ACTIVITIES

7.1 Cancellation by the client

– Cancellation of a booking up to 48 hours before: full refund of the deposit

– Cancellation of a booking less than 48 hours before: the balance will be required

In the event of force majeure and upon presentation of supporting documentation, Cors'Aventure may refund the amount paid, but this cannot be required by the client. In all cases, the client undertakes to notify Cors'Aventure of all notifications relating to the booking: programme organisation, change in numbers, delay or cancellation.

7.2 – Interruption during the service

In the event of interruption during the service, the client or participant shall not be entitled to any refund.

ART. 7A – CANCELLATION / INTERRUPTION BY THE CLIENT FOR STAYS

7.1 Cancellation by the client

– up to 30 days before the departure date: full refund (deposits and total balance).

– between 30 and 15 days before the departure date: the 30% deposit will be retained, the balance will be fully refunded.

– between 15 and 8 days before the departure date: 50% of the total price will be retained.

– between 8 and 2 days before the departure date: 75% of the total price will be retained.

– 2 days before the departure date: 100% of the stay price will be retained.

ART. 8 – CANCELLATION / EXCLUSION BY CORS'AVENTURE

8.1 – Cancellation

Cors'Aventure's instructors reserve the right to cancel or adapt the outing according to weather conditions or the level of participants.

The activity may be cancelled for safety reasons (weather, EDF water releases, flooding…) or for any other case of force majeure. In this case, a replacement activity will be organised where possible or another date will be proposed. If the outing cannot take place, the service is fully refunded without being entitled to any other compensation.

In the case of cancellation by us due to insufficient participants (fewer than 4 people), those registered will be fully refunded and will not be entitled to any compensation.

8.2 – Exclusion

Cors'Aventure's instructors reserve the right to exclude a participant who is intoxicated or whose behaviour is likely to disrupt the smooth running of the activity or compromise the safety of the group. In this case, the client or participant shall not be entitled to any refund or compensation.

ART. 9 – MEETING POINT

A meeting time and place are systematically communicated whatever the service. For the smooth running of activities and out of respect for other participants and the professional supervising you, we ask you to please take note of the route sheets and other indications previously sent to you. Make sure to plan your journeys so as to be on time. We tolerate a maximum delay of 15 minutes. Beyond this delay, the instructors leave for the activities and no refund or compensation will be claimable.

ART. 10 – SUPERVISION OF YOUNG PEOPLE (MINORS):

Unaccompanied minors:

Minors under 14 years of age not accompanied by an adult (legal guardian) are not accepted in so-called «collective» activities.

Minors aged 14 to 18 not accompanied may be accepted in so-called «collective» activities, subject to parental authorisation and certain conditions (sporting level, ability, ..)

In this case a parental authorisation will be signed by the legal representative on the day of the activity.

In the case where the activity requires travel to a site (cliff, canyons, cave, etc.), transport of the minor must be ensured by the legal representative.

Minors within the context of holiday clubs / school outings:

The organisation organising the stay or outing must be able to provide the instructor and SARL Cors'Aventure, for each participant (young person and supervisor)

– a certificate of swimming 25 metres and ability to submerge,

– the medical record of each participant.

Furthermore, Cors'Aventure undertakes to provide the necessary certificates and documents for the organisation of the stay/outing (DDCSPP authorisation, insurance, instructors' qualifications, etc.)

The supervision of young minors is subject to regulations limiting it to 8 young people and 1 supervisor (maximum). Each group of minors must be accompanied by 2 adults, one of whom is a centre supervisor and the supervising instructor.

ART 11. GIFT VOUCHER

The gift voucher is effective upon receipt of the full amount of the service.

The purchase order is nominative. However it can be transferred to the person of your choice provided you notify us in advance to update the details of the new beneficiary.

The beneficiary of the gift voucher must contact us to book the outing.

The gift voucher activity can be replaced by another activity offered by Cors'Aventure, provided that the value of the latter is less than or equal to the activity mentioned on the gift voucher. However it is possible to carry out an activity of a higher amount by paying the difference.

ATTENTION: The gift voucher has an expiry date. Once the validity period has passed (current year), the service will be considered as executed and cannot be carried over. The beneficiary and/or the buyer shall not be entitled to any refund or compensation.

The gift voucher and the nominative document must be presented on the day of the outing to the instructor in charge of the session.

The outing will be guaranteed provided the minimum required number of participants is met and weather conditions allow the activity to be practised safely.

ART. 12 – DISPUTE RESOLUTION

The parties will endeavour to resolve amicably any difficulties that may arise in the execution of the contract. If no amicable agreement can be reached, all disputes relating to the validity, interpretation and execution of this agreement shall be governed exclusively by the rules of French law.

All disputes, of whatever nature, shall fall within the jurisdiction of the French civil and commercial courts, including those ruling on interim measures.

II. EQUIPMENT RENTAL

ART 1. BOOKING

All our activities including equipment rental (canyoning, kayak and nautical base) are by reservation. For this, you have several options: by filling in the online booking form (www.corse-aventure.com) or by contacting Cors'Aventure directly by email (info@cors-aventure.com), by telephone (04-95-25-91-19 / 06-72-03-49-22) or at the reception of the base in Eccica-Suarella.

The booking is effective from the moment the subscriber receives a confirmation email.

Article 1: The period for which the contract has been concluded cannot be changed without the agreement of Cors'Aventure and subject to its possibilities.

Article 2: A deposit of 30% on the rental price is payable upon booking. This deposit will remain with the owner if a cancellation occurs less than 30 days before the rental. The renter undertakes to pay the balance of the sum no later than 8 days before taking possession of the equipment and a deposit upon collection of the equipment. If the rental is cancelled by Cors'Aventure for weather reasons, the deposit will be refunded.

Article 3: The rental amount will remain with the owner whether or not the renter has made use of the equipment during the rental, whatever the reason.

Article 4: In the event that, following a breakdown occurring during the previous rental, or any obstacle whatsoever beyond its control, the owner is unable to provide enjoyment of the equipment designated above, on the agreed date, the owner shall have full authority to make equivalent equipment available to the renter.

Article 5: Only navigation within 5 nautical miles of the coast is authorised. The renter undertakes to embark the number of persons provided for by the manufacturer. The renter alone shall be responsible towards the maritime and customs services for any proceedings, fines, prosecutions and confiscations incurred by them in the event of unintentional fault on their part. In the event of seizure of a rented boat, the renter must pay the owner a compulsory and contractual indemnity corresponding to the rental rate in force.

Article 6: The renter is required to return the equipment in good working order and condition, with all its equipment, as it was at the outset. If the condition of return is satisfactory, the deposit is returned to the renter.

Article 7: If deterioration or loss of equipment or accessories is noted, the renter is required to pay for the repair or replacement. The refund of the deposit will be deferred until the repair or replacement invoices are settled by the insurance company. This refund will be made taking into account the excess not refundable by the insurance company and all ancillary costs that the damage may have entailed.

Article 8: The renter is required to return the boat and equipment within the agreed timeframe.

Article 9: In the event of a breakdown, the renter is required to notify Cors'Aventure urgently, requesting instructions.

Article 10: Loss of use resulting from breakdowns occurring during this rental and not attributable to Cors'Aventure shall not be the subject of any refund of the rental amount, even partial.

Article 11: Subletting is strictly prohibited.

Article 12: All procedural costs arising from this rental shall be borne by the renter.

Article 13: For all disputes relating to the execution of this contract, and without amicable agreement, jurisdiction shall be expressly assigned to the courts of Corsica.

ART. 2 – PRICING

Rental rates are displayed on the website and on the activities brochure.

Prices include: rental of technical equipment.

Below are the different rental options:

Canyon shoe rental

Single or double sit-on-top Rotomod sea kayak by the hour, half-day, day or several weeks

Single or double Prijon touring sea kayak for several days

Paddleboard, Fun Boat and Hobie Cat 16 catamaran

Prices do not include: possible additional equipment rental (e.g.: GoPro, portable), transport to the activity location (meeting point and practice site) and personal expenses.

ART. 3 – PAYMENT METHOD

Payment must be addressed to the order of Cors'Aventure

Accepted payment methods: cheque, holiday vouchers, bank transfer, online payment or cash.

A deposit of €200 is required for Rotomod kayaks and a deposit of €500 is required for Prijon kayaks and will be returned upon return of the equipment. The balance must be paid no later than 8 days before collection of the equipment.

Opening hours are communicated at the time of equipment handover.

ART 4. INSURANCE AND LIABILITY

In the case of sporting practice with equipment, and especially in the case of rental of sporting equipment (outside activities supervised by an instructor) the client acknowledges having sufficient knowledge and technical skills to practise this sporting activity alone. The client practises in this case under full responsibility and at their own risk the activity for which the said equipment is rented. SARL Cors'Aventure cannot be held responsible in the event of an accident that may occur during the said unsupervised activity.

The team and SARL Cors'Aventure having no means of verifying the level of sporting practice of its clients, it is therefore up to each participant/client to have assessed their physical fitness, knowledge and skills in accordance with what they wish to do.

ART. 5 – INSURANCE

SARL Cors'Aventure is insured in Professional Civil Liability for its own activities and its liability cannot be engaged for any incident or accident that may occur during an unsupervised activity.

Furthermore, we strongly advise each participant to be covered by civil liability insurance and/or personal accident insurance with the insurer of their choice for the practice of mountain sports.

The practice of outdoor activities takes place in a specific environment known as a «risk» environment.

Each participant is aware, given the specific nature of the activities practised, that they may run certain risks due in particular to remoteness, isolation and the specific nature of the activity and environment (river, cave, etc.). They accept these knowingly and must comply with the rules of caution and follow the recommendations of the delegating federations (FFME) and the competent authorities (DDCSPP, municipality and prefecture).

The participant/client is responsible for the equipment assigned to them. SARL Cors'Aventure cannot be held responsible for any harm that may be caused by this equipment. In the event of theft, loss or deterioration of rented equipment, the participant/client will be asked for compensation related to wear or full reimbursement of the equipment.

SARL Cors'Aventure cannot be held responsible for the loss, theft (including from vehicles) or breakage of objects (e.g.: glasses, cameras…) that participants might take with them during the activity and that could occur during the activity.

ART. 6 – CANCELLATION / INTERRUPTION

6.1 Cancellation by the client

– A deposit of 30% on the rental price is payable upon signing the rental contract.

– This deposit will remain with the owner if a cancellation occurs less than 30 days before the rental.

– The renter undertakes to pay the balance of the sum and the deposit amount, no later than 8 days before taking possession of the equipment.

6.2 Cancellation by Cors'Aventure

– If the rental is cancelled by Cors'Aventure for weather reasons, the deposit will be refunded.
